Hey there, sorry for this last minute suggestion. This suggestion is for the SPT Carmine & Cream livery for the Cathcart Circle class 314. The interior is just the same just that the carriage door knob is silver and not blue. And the 'ScotRail is opperated by Abellio' sticker on the doors of the Saltire livery class 314. (Yes I do know thats a 380)
I don't believe DTG have the rights to use either of those. The base Scotrail brand is owned by the Scottish Government - Abellio seem not to licence (and their contract isn't being renewed with Scotrail going inhouse in the coming months) and SPT's Rail division doesn't exist any more and I'm not sure if they'd be interested in licencing a defunct livery.
The SPT Livery I haven't an reason for. It should have come with the route. All but 5 (2 got it later so 7, actually) kept the SPT Livery, so I think questions should be asked. Especially as the livery was Debranded, I doubt they can be copyrighted over making a train Cream & Carmine. After all that hasn't been a problem on TS, with the class 170 bearing a Debranded SPT Livery on Edinburgh - Glasgow, and WCML North having SPT Rail Signage, in the Scottish Area. The Abellio sticker is a minor thing which is quite pointless to go through the entire licensing process just for that. After all it is clearly just abellio, as Scotrail have worked with DTG clearly. As a Scot, I couldn't care less for the Sticker.
Excellent idea but the Abellio logo on the class 380 doors belongs to the Dutch Railways NS which is the double arrow logo. In order for that to work DTG needs Dutch Railways NS licensing or otherwise Dutch Railways can sue DTG for using their trademark Arrow without a license from them.
That livery would be really simple to make in Livery Designer for those with a spare hour. Whatever anyone says above about permissions, licenses, copyrights and not getting sued etc is irrelevant because it’s too late anyway, the train has been made with the spotty blue livery and that’s all that will be included.
Absolutely correct and there is going to be a problem with Abellio Scotrail is that DTG needs the Dutch Railways NS Licensing due to the trademark double arrow logo. Otherwise NS Dutch Railways can sue DTG for putting in the arrow directly without the license
As far as I can see they haven't included the "Operated by Abellio" text on the doors - given Abellio have forfeit their contract for Scotrail they'd be unlikely to approve and the unbranded version will be fine for the future in house operator
Which is what I said - "In House Operator" as opposed to Outsourced or Contracted out. Legally Scotrail will have an operating company - just the Limited Company (ie Scotrail Operations Ltd) will be owned by the Scottish Government
There isn’t going to be any problem. Nobody is getting sued. If DTG use any logo in TSW it means they have the permission to use it. If they don’t have permission, they won’t use it.
I swear u love bringing the abellio arrow up in conversation! As I’ve mentioned before, this won’t be a problem because the route is set in the days of first scotrail
I can dispute that, as on last week's stream the route was shown to be 2017, when viewing the scenarios. So it's very much Abellio unless that's just an error.
