More Logo's/Branding Into Livery Designer would work great with making new livery's for the trains in tsw3 1: Logo's/Branding Such As: Old Thameslink Logo, Southeastern logo, Amtrak Logo, First Capital Connect Logo, First Great Western Logo, Modern Great Western Railway Logo, London Midland Logo, More Gatwick Express Logo's, EWS Logo, Freightliner Logo, Connex Logo, Connex South Eastern Logo, Network SouthEast Logo, BR Logo, I.C.E Logo, Cross Country X Logo, East Midlands Trains Logo, South West Trains Logo, First North Western Logo, ScotRail Logo, Great North Eastern Railway Logo, London Northwestern Railway Logo, East Midlands Railway Logo, London Overground Logo. I know that there will be some trouble getting some of these logo's into the game ik its abit much just hope at least some new logo's will appear into the game. because of that ive got a other idear. 2: With Livery Designer what if the train numbers were enabled in the Livery Designer so if like you picked a random reskin from the workshop and it has a number such as: 323412. and if you picked a 6 coach train with that same livery the train's would have the same numbers. What i was thinking is that your able to paint under the numbers making that work would make it 5x more realistic. this might work this might not just cross fingers it could work. it should be easy. 3: another idear i've thought of is that your able to edit the train livery's and change them around. not like other peoples work like in workshop like the org train livery's like southern like for example you could remove the logo's off that train and put like thameslink logo's or southeatern or first great western logo's on it. i think this would work good with the game. hope these 3 idears are possible. have a nice day.
Yeah are you sure about that one mate. Scotrail like have there own route with there lgoo and everything on it so i dont know where you've got that info from.
I don't get that kind of attitude from these TOCs, more so if they have IP included in the game's content, like CN & Amtrak for instance. Is it just a case of stuffy suits not understanding the medium? Personally I take no notice of these restrictions because they are ridiculous for how rigid they are, I mean we don't know the ins & outs of a deal (say financially...), but one speculative layer I imagine is misrepresentation. Almost as if assuming bad faith is a safer bet to protect their brand, but that would be an out of touch cop out, especially when appealing to people who love these trains and want to recreate them IMHO. I reckon logos belonging to specific TOCs or older associated designs should be included with each dlc as decals, with Mastery rewards, so UP with Sherman Hill, Norfolk Southern with Horseshoe Curve. etc. I mean we have a Thameslink & Avanti logo with no content in game, and not even the current GWR logo, it's all a bit disjointed really.
Why not add in OBB & OBB Wiesel logos followed HVV Hamburg Verkehrsverbund and Rhein-Main Verkehrsverbund RMV this is seen on TSC DB BR423 S-Bahn Rhein-Main S5/S6 DLC? OBB Logo matches the 182 because one can make an OBB Baureihe 1016 & 1116 from the 182.
Yea, it makes no sense. Plus, It would give their train company a bit more advertising so it seems like a win win for everyone? But why isn't it? I have numerously requested Scotrail logo for livery designer as well as the arrow dots pattern. We might get it with this new route. We'll just have to wait and see
I can see the reasoning. In livery designer, it means that players can slap the logo on any design that they want - which the TOCs won't be overly keen on. As for GWR, apparently the license has more or less collapsed.
Is that why they call it 'GWB' now? I can see the reasoning if you lay it out too, but it still comes across as stuffy because the same principle can be applied to any kind of livery mod from the internet or logo mod for the PC version of TSW, these companies could go after them, but they don't, it's usually dedicated fans who want realistic items in games and I don't think it'd do their image much good to be so petty if it's a free mod. That's the point of the livery designer right, to be able to slap a logo on any design you want. Fair use and transformative should apply here, I mean you're often paying for the privilege if it's a specific piece of rolling stock. Now we should all expect if you make a design that says '*insert TOC here* is the worst, all the bad things etc.' It probably won't stay up for long as the onus falls on DTG to moderate & interpret misrepresentation, like they already do, so they have nothing to complain about really.
GWB is the name of the Diesel Legends of the Great Western DLC, standing for: Great Western (BR) Blue, or so I've been told. Alternatively it's DLoGW. TOCs won't chase after free mods because that's a whole different thing. When it comes to TSW, they have licensing agreements with DTG to use their brand how they want it to be used - and if it's used inappropriately it will be withdrawn. Yes and no for the first point. Some brands will be quite reserved around their brand, others will be more relaxed. It depends really what's going on at HQ and as Matt has said before, it's the TOCs brand at the end of the day. Fair use and such don't apply because it's not a legal thing, it's an agreement. The TOCs (afaik) don't have obligations to uphold the agreements. Again, a question for Matt. There's a reason that for the Creators Club it was a case of 'These TOCs have allowed us to use their brands' as opposed to 'These TOCs have prohibited us from using their brands.' - it's the company's choice. You don't pay for said privilege, you pay for the ability to play the train and/or the route it's with (if applicable) - Livery Designer is just a feature. DTG can't moderate everything really, somethings will slip under the radar. It's the same as Crash Videos. TOCs don't like to see themselves - pretty much exploited - in ways they won't like.
I appreciate the clarification. Though I would disagree, Fair Dealing does apply to each user as they are not privy to any agreement with a TOC, we make parody/pastiche in this case. It's not our problem to keep them happy essentially. DTG even have their own parody of the SWR Island Line themselves, but of course that is commercial, so they couldn't use the official brand without permission. And while I also appreciate this might make things trickier for moderators & letting things through the cracks, the more rigid TOCs need to get with the program basically (IMHO). Indeed, you pay for access to a route and or extra rolling stock though again I would disagree, if livery designer (and by extension Creators Club) is a feature that requires rolling stock in order to use, your are paying for the privilege in order to access that feature. Even if it's a base package, with applicable stock.
You are paying for the Rolling Stock, and you get to use it in LD, which you already have. So? The TOCs still have absolutely every right to withdraw their brand. Fair Use only comes into play if they try and use legal action. If they see something they don't like they like, they can request that DTG remove it. Dovetail have the right to remove anything they want from creators club.
Now you can play the game without using the tool, or you can use the tool without playing the game, but you still have to buy the game first. Yup. A TOC is free to act as they wish and dovetail can do what they like with their platform (and if they want to stay rigid, it's up to them). I'm arguing that if the only incentive to follow these rules is avoiding a takedown for a TOCs non-legal stance on representation, it isn't a very good one if it's above our heads & people can get around the rules anyway. It is their brand, yes, nobodies saying it isn't. The grey area is the intent a user has with a brand, which should leave room for exception if it isn't commercial. So above you being an unofficial spokesperson for DTG & every TOC with a gripe, more content for the game is something we should all hope for too at the end of the day. Above board and as much as we can get away with. (*Getting back on track heh.) One thing I would also like to see in future is being able to paint shipping containers, branding them as you wish, that would be sweet.
Fair Use in the UK is much more restrictive than in the US. Also Trademarks are treated differently to general copyright. It's also probably best for DTG to play it safe both to avoid Legal Action, and so the Train Companies are willing to provide assistance in the future.
