A while back I posted a made up Norfolk Southern livery for the ICE 1; But alas no matter what it keeps being taken down and I would LOVE to know why. On the grounds of 'copyright infringement', I don't buy that at all. More so given there are plenty of other NS creations in the club untouched for over 2 years now. This one is the most troublesome thus far, even tried taking 'Norfolk Southern' out of the blurb completely but surely this can't just be a case of an overzealous admin or plain jealous loser reporting me. Either way the fact it keeps being taken down it's pure BS.
Hi,,,,I may do some quick research on this but on my first thoughts I don’t think it has anything to do with the US Livery side but more to do with the ICE and the rights of it. It maybe something to do with licensing rights and what’s is acceptable when using the ICE. As licensees they may not want it to be associated or treated in a manner they see un fit. DTG may have been given outlines the rights for use in game yet with certain limitations of right of use by its users. Again for the licensee holder own protection,,,as it’s not always dos to Copyrights but Trademarks too. I say this because I believe DTG also had some issues it’s self and why some German units are not available for editing. This was some time back tho and not to sure which ones it was exactly. So when I get time I’ll look into this and also as I say it’s not necessarily the NS livery but the use of the ICE Unit itself. NS is a US Freight Service where they may only want Passengers livery’s only used or seen on a ICE. I understand your frustration and interested myself as to why,,,so when I get time I’ll look into those what possible reasons it could be. All the Best to you. (TSLP).
Well I appreciate the thought in seeking further info. The ICE 3 is definitely covered by the trademark protection, same for the G6. I think there's a disconnect here between company and just a not-for-profit creative endeavour, like if someone paints a model, a PC skin mod or photoshops a livery onto a unit that's never used a certain brand. DTG should care because it's them doing the legal legwork & actually talking to these TOCs, we can only extend the courtesy to oblige the rules imposed on us as end users by DTG because TOCs have that disconnect in not understanding the medium. I have no incentive to listen to them when all I want to do is share freeware skins for recreational purpose, it ultimately makes no sense to me when the rules are so broad in practice to begin with. More so galvanizing when the 'report' function is so basic & hands off, being open to abuse, it could be as simple as someone not liking your work, which has happened many times before. Plus I have dressed the ICE 1 in Burlington Northern & CN liveries, of which passenger services are long defunct or only do freight. I've also never had issue with the BN & LNER versions.
