If the names are visible, definitely both. In the past, a lot of packs included liveries but without branding. BNSF stuff is the most recent, but the DB Schenker Class 37 or several old HST and 158 pack liveries are like that. Sometimes it's so low detail you hardly make it out, like the Florida & California "commuter railways". In theory the paint scheme might be copyrighted (like a logo) and that would require licensing (so in specific cases, one has to research), but railroads aren't that sassy about using it, but the names. (For example in the Netherlands, Norfolk Southern clashes with Nederlandse Spoorwegen.) There is a bit of money in it (would you buy Donner Pass with generic gray trains) but it's change for a railroad and more about lawyering I think.
Simply put, yes. VRC's C39-8's are the best example of this. The pack came with "Patched" Ex-Conrail Units, that were completely void of any CR markings due to DTG not having a CSAO license (The NS Heritage Unit doesn't count) VRC also offered a branded CR unit on their own site before they left the community.
